Section 6B
Can be declared a riot zone
:
(1) If there is a situation in any area where a procession, mob or organized group commits violent or destructive acts such as looting, setting fire to houses or shops, vandalizing public property with or without arms, and if it is felt that this cannot be prevented by normal police action, the Chief District Officer The said area can be declared riot prone. After declaring a riot-prone area, the Chief District Officer may take any or all of the following actions to maintain peace and order in that area:
(a) To arrest suspicious persons in such area without warrant and detain them in accordance with the Public Safety Act, 2046,
(b) To shoot as soon as he sees any person committing looting and setting fire to houses or shops, vandalizing public property or other violent or destructive acts in such an area.
(c) Prohibiting any kind of assembly, procession, assembly, meeting or demonstration or posting or writing propaganda material such as posters, pamphlets in such area,
(d) Arranging the supply of essential goods in such areas, controlling the transportation, storage, sale and distribution of such goods,
(e) To close any other institution, entertainment center and office including educational institution in such area,
(f) Prohibiting strike in any essential service in accordance with the Essential Services Operation Act, 2014 in such areas,
(g) prohibiting the assembly of five or more persons in such area,
(h) imposition of curfew in such area,
(i) To take the help of the Nepali Army if deemed necessary for the above activities in such area.
(2) If it is suspected that illegal arms and ammunition are kept in the riot-affected area, by the order of the Chief District Officer, police officers up to the rank of Assistant Inspector of Police may search the house, shop, compound or godown etc. of any person in such area without prior notice. (3) Sub-section (1)When declaring a riot-affected area, the Chief District Officer can only declare it for a maximum period of one month at a time. If the said period needs to be extended, the Chief District Officer can extend the said period for another three months with the approval of the Government of Nepal, Ministry of Home Affairs.
(4) Information that the chief district officer has declared a riot-affected area should be given to the regional administrator and the Ministry of Home Affairs immediately.
(5) Any person who violates Clause (e) or (g) of sub-section (1) or who opposes obstruction during the taking of house search in accordance with sub-section (2) shall be punished with imprisonment for a term which may extend to three months or with a fine which may extend to three thousand rupees or with both, following summary procedure as deemed fit by the Chief District Officer. can and an appeal will be made to the district court on the said punishment order.
